RESOLUTION 2001-47

 

        (Amending Skamania County Personnel Policy, Resolution 1985-36)

 

 

WHEREAS, Resolution 1985-36 adopted a comprehensive personnel policy for Skamania County and amended it per Resolution 1986-19, by Board of Commissioners action on June 13, 1988, Resolution 1989-34,  Resolution 1990-10,  Resolution 1990-38, Resolution 1990-39, Resolution 1992-12, Resolution 1992-16, Resolution 1993-25, Resolution 1994-17, Resolution 1995-07, Resolution 1997-23 Resolution 1998-40 Resolution 1999-10, Resolution 1999-18, Resolution 2000-25 and Resolution 2001-35; and

 

WHEREAS, the Skamania County Board of Commissioners finds an amendment to Section 12.10 of the Personnel Policy is necessary for consistency with the law; and

 

WHEREAS,  the Board desires to adopt a new  travel policy as Chapter 20 of the Personnel Policy for county employees to better meet state and federal regulations and to clarify various travel authorization and reimbursement issues; and

 

WHEREAS, the state and federal law recognizes family medical leave and the county desires to adopt a new section 14 under Chapter 12 of the Personnel Policy which establishes the county policy and procedure for family medical leave for county employees;

 

NOW, THEREFORE, BE IT RESOLVED that effective immediately upon signing section 12.10 of the Comprehensive Personnel Policy is hereby amended as follows:

 

            Section 12.10 shall be changed to read:

 

12.10 MILITARY LEAVE

 

A.    Under RCW 38.40.060, aAny employee who is a member of the Washington Nnational Gguard or of the army, navy, air force, coast guard, or marine corps reserve of the United States, or of any organized reserve or armed forces Reserves of the United States and who is ordered to active military duty or take part in active for training purposes shall be granted military leave of absence with pay for a period not to exceed fifteen calendar days each calendar year.  During the military leave time, the employee shall receive his/her regular pay to fulfill the annual active duty requirements of the employee’s unit. Any working days military leave taken beyond fifteen calendar days must be charged may, at the option of the employee be taken as annual leave or leave without pay.  If a reservist requests leave to attend military training, the county must grant it.  The County is not, however, required to rearrange a reservist's work schedule to avoid a conflict between work and military training,

 

B.    Employees hired after July 1, 1982 who take military leave, the County will continue the employees regular pay.  Upon receipt of the employees military base pay, that amount, excluding any special allowances and up to the amount of their County pay, will be paid to the County Treasurer.

C. B.Pursuant to the Uniformed Services Employment and Reemployment Right Act (38 USC 4301 et.seq.), aAny employee who voluntarily or upon demand leaves a County position (other than a temporary position) to enter upon active duty in the armed forces of the United States or the National Guard shallmay be entitled to be restored to his/her former position, or one of like seniority status and pay provided .  Provided the employee qualifies and complies with the Act’s substantive and procedural requirements.

 

1. Application for re-employment by that person is submitted to the County within ninety days of discharge or separation, and proof that the person is physically capable of performing the work required in his/her former position is furnished by that person.

 BE IT FURTHER RESOLVED that the attached Family Medical Leave policy be adopted as a new Section 14 of Chapter 12 in the Skamania County Personnel Policy effective immediately upon signing; and

 

BE IT FURTHER RESOLVED that Resolutions 1983-24 and 1990-23 be rescinded in their entirety and that the attached travel policy be hereby adopted as Chapter 20 of the Skamania County Personnel Policy, effective September 1, 2001; and

 

BE IT FINALLY RESOLVED that, except as herein modified, Resolution 1985-36 and its subsequent amendments approved by the Board of Commissioners are hereby affirmed in their entirety.

            WHEREAS, the undersigned, being duly elected to public office in Skamania County, hereby collectively agree to abide by the amendments of and addition to the comprehensive personnel policy referred to above in Resolution 2000-25:

 

            NOW, THEREFORE, BE IT RESOLVED, that each of the undersigned adopt the same as amendments and additions to the Skamania County Personnel Policy which will be in effect during their term(s) of their office until and unless further action is taken regarding the same.
