(New Skamania County Title 23 Application Fees)

 

 

Whereas, the 1997 Legislature adopted changes to the Washington State Forest Practices Act in Substitute Bill 5714, which became effective on July 27, 1997, and which allows local governments to regulate conversions of forest land to non forestry use; and

 

Whereas, RCW 76.09.060 allows the local government entity to develop an administrative process for lifting or waiving the six-year development moratorium placed on a parcel at the time of approval by the Department of Natural Resources of a forest practices application; and

 

Whereas, Skamania County has adopted Title 23 - Forest Practices Moratorium Ordinance to provide this process of lifting or waiving the six-year moratorium; and

 

Whereas, the above referenced ordinance contains language stating “The County may charge a fee for review of applications. Fees shall be established by the Board of County Commissioners from time to time, by resolution”; and

 

Whereas, the County is providing a substantial public subsidy for land use permitting services to individual applicants; and

 

Whereas, the County believes it is in the public’s best fiscal interest that individual applicants pay for a portion of the actual cost of the processing of land use applications and permits in Skamania County;

 

 

NOW, THEREFORE, Be it further resolved by the Skamania County Board of Commissioners that the Skamania County Department of Planning and Community Development shall charge the following processing fees:

 

Application to Waive or Remove Moratorium under RCW 76.09.060   $270.00
