RESOLUTION 2008-06

 

(Amendments to the Skamania County Personnel Policy dissolving the Personnel Committee, clarifying relationship between county and employees both represented and non-represented, and clarifying Labor and Industries policies and procedures)

 

WHEREAS; the Skamania County Personnel Policy shall be uniformly administered in all departments of County government; and

 

WHEREAS; the policy shall be periodically reviewed to consider changes in county needs and goals, and state and federal law; and

 

WHEREAS, it is the desire of the Board of County Commissioners (BOCC) to review and to clarify these policies; and

 

WHEREAS, the Board deems that

1)      Employees who have performed 20 or more years of service to the county should be afforded the opportunity to be eligible to receive certain benefits for that service.

2)      That the functions previously assigned to the Personnel Committee should be the responsibility of the Board of Commissioners and the Personnel Committee should be dissolved.

3)      Represented (union) wages are determined through bargaining. Non represented wages are determined by the Board. The Board may award non-represented wages higher or lower than those that are bargained.

4)      The BOCC is not required to look at an entire department’s seniority structure or the county as a whole if the BOCC eliminates an entire program.

5)      Employees injured on the job should not be required to use up leave while adjudicated as being eligible for Labor and Industries (L&I) compensation, as well as loosing a portion of their base pay because of L&I formulas.

6)      Leave without pay is not granted for taking examinations for local government positions and administrative leave is created when declared by the BOCC.

7)      The county will distinguish between state mandated bargaining and negotiation for union employees and that which is required for non union employees.

 

NOW, THEREFORE BE IT RESOLVED, that the Skamania County Personnel Policy:

 

Chapter 1 – Definitions:

1.            Under the section defining retirement include the following language at the end of the first sentence “and/or separation from service in good standing after completion of 20 or more years of service.”

 

2.            Under the section defining Preface, delete all references to the “Personnel Committee, and insert the Board of County Commissioners”

 

Chapter 3 - Delete all references to the Personnel Committee, their responsibilities, requirements and duties and, where necessary, including of all of section 3.3.6 in its entirety, and insert the “Board of County Commissioners”

 

Chapter 4 – Delete all references to the “Personnel Committee, their responsibilities, requirements and duties and where necessary insert the Board of County Commissioners”

 

Chapter 5 – Delete all references to the “Personnel Committee, their responsibilities, requirements and duties and where necessary insert the Board of County Commissioners”

           

Chapter 6 –

1.      Delete 6.1.3 “Provide equity between represented and non-represented employees;”

 

2.      Delete 6.2.5 “The compensation provided to employees excluded from the bargaining units shall be no less than compensation awarded to bargaining unit employees.”

 

3.   Delete all references to the “Personnel Committee, their responsibilities, requirements and duties and where necessary insert the Board of County Commissioners”

 

Chapter 10 – Layoff and Recall insert a new section 10.3.1.3 that states “In the event that an entire county program is eliminated nothing in this policy requires that the county consider seniority of program participants in the county as a whole but simply consider seniority within the program, except as enumerated within negotiated contracts.”

 

Chapter 12 –

1.      Section 12.8.8: Sick Leave Buy Out at Death or Retirement is amended as it relates to the definition of retirement in Chapter 1.

 

2.      Section12.9: Leave for On the Job Injuries – strike 12.9.4 in its entirety, strike 12.9.5 in its entirety, and strike 12.9.6 in its entirety, replacing all with the following;

 

3.      Section 12.9:  When L & I makes a decision to allow the claim, the employee shall turn said checks over to the county and will be paid their full base salary without being required to use accumulated leave to make up the difference between Worker’s Compensation and the employee’s base salary.  If a period of time elapses from the application for Worker’s Compensation and the receipt of payment from L & I, said employee will turn over said payment and have their leave restored for the period. At six months from the date of the claim and each six months thereafter, the Board of County Commissioners shall review the situation and determine if the employee shall be required to use sick and/or annual leave to make up the difference between the compensation from L & I and the employee’s regular salary from the point of review.

 

4.      Section 12.11: Other Leaves with Pay strike “to take examinations for local government positions.” Create a new section titled Administrative Leave allowing the granting of administrative leave upon authorization of same from the Board of County Commissioners.

Chapter 13 – section 13.1 strike “whether union or not union”

 

Be it further resolved that this resolution shall take effect on January 1, 2008, and shall repeal or modify any other resolution or policy inconsistent herewith.

NOW, THEREFORE, BE IT RESOLVED, that each of the undersigned being duly elected to public office in Skamania County hereby collectively agree to abide by the Skamania County Personnel Policy with all amendments and additions hereto which will be in effect during their term(s) of their office until and unless further action is taken regarding the same.
