RESOLUTION 2007-38

 

(Adopting, Endorsing and Certifying by Motion the Skamania County 2007 Swift Subarea Plan and Associated Maps)

 

WHEREAS, RCW 36.70 authorizes Counties to engage in creation of Comprehensive Plans, Subarea Plans and the adoption and certification thereof by motion; and,

 

WHEREAS, the creation, adoption and certification of Comprehensive Plans and subarea plans are considered a legislative process and not subject to RCW 36.70C; and, 

 

WHEREAS, the Washington State Legislature in 1990 Passed the Growth Management Act (RCW36.70A) requiring all counties to prepare or update their Comprehensive Plans to provide guidance to bring their ordinance into compliance with the Critical Areas requirements and the Commercial Resource Protection requirements; and,

 

WHEREAS, on March 20, 2007 the Board of County Commissioner’s (BCC) initiated the draft of the 2007 Comprehensive Plan.  This draft includes the Critical Areas Best Available Science guidance; and,

 

WHEREAS, on March 28, 2007 a Determination of Non-Significance (DNS) was issued and reviewed under the State Environmental Policy Act (SEPA) was completed, since no appeals were filed; and,

 

WHEREAS, on March 27, 2007 a draft plan and a 60-day notice of intent to adopt were sent to Washington State reviewing agencies meeting the notice requirements of the Growth Management Act; and,

 

WHEREAS, the Planning Commission held a workshop on April 17, 2007 to discuss the draft plan and associated maps; and,

 

WHEREAS, the Planning Commission, having provided proper notice in the official newspaper of general circulation, and with a quorum present, conducted a public hearing on the March 20, 2007 BCC Initiated Comprehensive Plan and associated maps on May 1, 2007 at the Rock Creek Center at 7:00 p.m.; and,

 

WHEREAS, the public hearing was continued to May 15, 2007 at 7:00 p.m. at Rock Creek Center for further public testimony; and,

 

WHEREAS, after all those attending the hearing were given the opportunity to speak, the public hearing was closed to public testimony at the end of the evening on May 15, 2007.  The public hearing was continued to June 5, 2007 for Planning Commission deliberations on the Swift Subarea Plan text and associated maps; and,

 

WHEREAS, only map deliberations were held on June 5, 2007, so at the conclusion of the June 5, 2007 public hearing; the public hearing was continued a second time to June 12, 2007 for deliberations on the last map requests and all text requests; and,

 

WHEREAS, on June 12, 2007 after reviewing the public testimony, both written and oral, discussing and analyzing the testimony, the Planning Commission recommended to accept the 2007 Board of County Commissioner’s Initiated Draft Swift Subarea Plan and to recommend that the County Commissioners review and accept the following changes:

 

    1. On Figure 2-1, the land use designation map, Sections 1, 11, and 12 of Township 7 North, Range 5 East change to S-CRL40.
    2. On page 13 of the text, line 7 add a space between the words “2006” and the word “and.”
    3. On page 13 of the text, line 9 replaces the number 335 with the number 339 to be consistent with Table 2-1.
    4. On page 21 of the text staff will draft language to clarify seasonal recreational usage based on Planning Commissions discussion, and forward that to the Board for acceptance.
    5. Modify Policy LU.3.1 (c) to read as “fish and Wildlife Habitat” and “Bull Trout Habitat” rather than “Key Fish and Wildlife Habitat” and “Bull Trout Spawning Habitat.”
    6. Add new Policy LU.3.5 “All plats, short plats, development permits, and building permits located within big-game range should contain a notice that the property is located within big-game range and that year round damage to property and landscape may result, and that individual property owners are liable for any damages incurred.”
    7. Correct the text for all designations (SR, S-CRL40, S-FL20, MR20, MR10 and MR5) to list “Public, semi-public, and private water facilities and utility systems should be allowed.”
    8. Add the following new item “q” on page 20 of Mountain Recreational Designation text:  “limited small-scale commercial uses related to recreational activities should be listed as a Conditional Use with specific development criteria.”
    9. Amend Policy LU.4.2 to include motorized Off Road Vehicles (ORV), to be consistent with the policy in the 2007 Comprehensive Plan.
    10. Add the following new item “z” on page 19 of the Swift Recreational Designation text (Copy item “o” from page 20:  “new extraction or processing of mineral resources should be prohibited.  However, existing legally established mineral resource extraction and/or processing sites may continue to operate and may apply to expand by Conditional Use Permit.”

 

WHEREAS, the Board of County Commissioners reviewed the Planning Commission’s recommended changes at workshops on July 24, 2007 and August 29, 2007; and,

 

WHEREAS, RCW 36.70.440 allows the Board of County Commissioners to approve by motion and certify Comprehensive Plans and Subarea Plans, after receipt of the report and recommendation of the planning agency without further reference to the planning commission, provided that the plan conforms either to the proposal as initiated by the county commissioners or the recommendation thereon by the planning commission.  No further pubic hearings are required since the planning agency issued its report within 90 days of the Board of County Commissioners Initiating the draft text and maps; and,

 

NOW THEREFORE, BE IT RESOLVED, that the Skamania County Board of Commissioners adopts and endorses the Final 2007 Swift Subarea Plan and Associated Plan Maps as recommended by the Planning Commission.
