RESOLUTION No. 2007-16

 

Vacating Beacon Rock Moorage Road While Reserving Public Utilities Easement

 

WHEREAS On April 24, 2006, the Board of County Commissioners, in Resolution 2006-22, declared its intent to vacate Beacon Rock Moorage Road and directed the County Engineer to report on the road as required by Chapter 36.87.040, R.C.W.; and

 

WHEREAS the Board received the Engineer’s Report and set a public hearing on the proposed vacation; and

 

WHEREAS all of the notices of the hearing were properly published and posted as required by Chapter 36.87.050, R.C.W.; and

 

WHEREAS, on May 15, 2006 the Board held a public hearing where public testimony was received, considered and recorded, and continued the hearing to 1:30 AM, Tuesday, April 3, 2007.  On April 3, 2007 the public hearing was reconvened; and 

 

WHEREAS the Board of County Commissioners has determined that Beacon Rock Moorage Road is not a useful part of the County road system and that the public would benefit from its vacation;

 

NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Skamania County, Washington does hereby vacate Beacon Rock Moorage Road as a County Road and as described as follows:

 

                A strip of land 30 feet in width, being 15 feet on either side of the

            following described centerline, except that where said centerline

            crosses under railway bridge No.44-3 it shall not exceed 12 feet in

            width, being 6 feet on either side of said centerline.

 

            Beginning at a point in the centerline of State Highway (Evergreen

            Highway) in the north half of the northeast quarter of said Section

            35; thence South 56 degrees 40 minutes East a distance of 99.75

            feet to the beginning of a 20-degree curve to the left, to which

            curve the above course is tangent; thence along said 20-degree curve

            to the left a distance of 147.16 feet through an angle of 29 degrees

            26 minutes; thence South 86 degrees 06 minutes East tangent to the

            above curve a distance of 112.62 feet to the beginning of a 3-degree

            curve to the left, to which curve the last mentioned course is tangent;

            thence along said 3-degree curve to the left a distance of 563.33 feet

            through an angle of 16 degrees 54 minutes; thence North 77 degrees

            East tangent to last above mentioned curve a distance of 661.37

            feet to the beginning of a 50-degree curve to the right to which

            curve last above course is tangent; thence along said 50-degree

            curve a distance of 125.5 feet through an angle of 62 degrees 45

            minutes; thence South 40 degrees 15 minutes East tangent to last

            above mentioned curve a distance of 60 feet more or less to the

            southerly right-of-way line of said Railway Company, said last

            mentioned course passing under railway bridge No. 44-3 (over

            Woodard Creek) a distance of 6 feet east of the east face of the

            west abutment of said bridge. 

 

BE IT THEREFORE ORDERED BY THE BOARD OF COUNTY COMMISSIONERS OF SKAMANIA COUNTY, WASHINGTON in accordance with R.C.W. 36.87.060, that

 

(1)   BEACON ROCK MOORAGE ROAD No. 12380, shall be vacated and abandoned in its entirety from Mile Post 0.00 to Mile Post 0.33 (end); and

 

(2)   This Resolution shall be recorded with the County Auditor in reference to the affected adjoining or underlying parcels.
