RESOLUTION 2007-12

 

(Adopting, Endorsing and Certifying by Motion the West End Community Comprehensive Subarea Plan and Associated Plan Maps)

 

WHEREAS, RCW 36.70 authorizes Counties to engage in creation of Comprehensive Plans and the adoption and certification thereof by motion; and,

 

WHEREAS, the creation, adoption and certification of Comprehensive Plans and subarea plans are considered a legislative process and not subject to RCW 36.70C; and, 

 

WHEREAS, on December 19, 2005, the Board of County Commissioners initiated the draft of the Amendment to Comprehensive Plan “A” – Westend Subarea Plan; and,

 

WHEREAS, on January 4, 2006 a Determination of Non-Significance (DNS) was issued and review under the State Environmental Policy Act (SEPA) was completed, since no appeals were filed; and,

 

WHEREAS, on January 4, 2006, a draft plan and a 60 day notice of intent to adopt were sent to Washington State reviewing agencies meeting the notice requirements of the Growth Management Act; and,

 

WHEREAS, the Planning Commission held a workshop on January 17, 2006 to discuss the draft plan and map; and,

 

WHEREAS, the Planning Commission, having provided proper notice in the official newspaper of general circulation and with a quorum present, conducted a public hearing on the Westend Subarea Plan and associated plan maps on February 7, 2006 at the American Legion Hall at 7pm; and,

 

WHEREAS, after all those attending the hearing were given the opportunity to speak; the public hearing was closed to public testimony at the end of the evening on February 7, 2006.  The public hearing was continued to February 21, 2006 for Planning Commission deliberations on the map and text; and,

 

WHEREAS, at the conclusion of the February 21, 2006 public hearing, the Planning Commission passed three motions.  Motion number 1 recommended the previous draft (2004 West End Community Comprehensive Plan and map) be adopted, with the exception that the “Five Corners” area not be designated as Neighborhood Commercial.  The second motion was to designate the “Five Corners” area as Rural Lands 2.  The third motion was to have cell towers listed as Conditional Use in the Rural Lands 2, Rural Lands 5, and Rural Lands 10, and as Administrative Review in the Forest Lands 20; and,

 

WHEREAS, the Board of County Commissioners received notice of the Planning Commission’s recommendations for the draft Westend Subarea Plan as modified and associated plan maps as modified, the minutes of the Planning Commission meetings (January 17, 2006, February 7, 2006, and February 21, 2006), the Planning Commission’s motions to modify the draft, a copy of the modified draft plan and maps, and copies of the written comments submitted to the Planning Commission; and,

 

WHEREAS, the Board of County Commissioners held a workshop on May 8, 2006 and October 18, 2006 to discuss the Planning Commission’s draft version of the Westend Subarea Plan and associated plan maps; and,

 

WHEREAS, the Board of County Commissioners, having provided proper notice in the official newspaper of general circulation and with a quorum present, conducted a public hearing on the Westend Subarea Plan and associated plan maps on November 28, 2006 at Canyon Creek Middle School at 7pm; and,

 

WHEREAS, after all those attending the hearing were given the opportunity to speak; the public hearing was closed to public testimony at the end of the evening on November 28, 2006.  The public hearing was continued to December 18, 2006 at the Fire Hall for Board of County Commissioners deliberations on the map and text; and,

 

WHEREAS, on December 18, 2006, after reviewing the public testimony, both written and oral, discussing and analyzing the testimony, reviewing the Planning Commission’s recommendation, the Board of County Commissioners decided by motion to modify the Westend Subarea Plan Map to remove the Neighborhood Commercial Designation at the “Five Corners” area and replacing it with Rural Lands 2; add Community Commercial and Neighborhood Commercial Designations to the Washougal River Road area; unanimously agreed that no changes will be made in Section 20 of Township 2 North, Range 5 East, WM; the Planning Commission’s recommendation for the text of the Plan would be accepted with the modifications to list all new cell towers as conditional use permits in all designations, to change the Neighborhood Commercial 5,000 square feet total floor area to 5,000 square feet footprint, and to include a subcategory in the Commercial Designation to include Community Commercial; and,

 

WHEREAS, on December 27, 2006, the Board of County Commissioners initiated the December 2006 draft of the West End Community Comprehensive Subarea Plan based on the above listed changes and returned the draft to the Planning Commission for Public Hearing; and,

 

WHEREAS, on December 27, 2006 a Modified Determination of Non-Significance (DNS) was issued for the new December 2006 BCC Initiated Draft, and review under the State Environmental Policy Act (SEPA) was completed, since no appeals were filed; and,

 

WHEREAS, on December 27, 2006, a draft plan and a 60 day notice of intent to adopt were sent to Washington State reviewing agencies meeting the notice requirements of the Growth Management Act; and,

 

WHEREAS, the Planning Commission, having provided proper notice in the official newspaper of general circulation and with a quorum present, conducted a public hearing on the December 2006 BCC Initiated Westend Subarea Plan and associated plan maps on February 6, 2007 at the Canyon Creek Middle School at 7pm; and,

 

WHEREAS, after all those attending the hearing were given the opportunity to speak; the public hearing was closed to public testimony at the end of the evening on February 6, 2007; and,

 

WHEREAS, On February 6, 2007, after reviewing the public testimony, both written and oral, and discussing the testimony, the Planning Commission recommended to accept the 2006 BCC Initiated Draft Westend Subarea Plan as presented, and to recommend that the County Commissioners review the designations in Section 20, Township 2 North, Range 5 East, WM; and,

 

WHEREAS, the Board of County Commissioners received notice of the Planning Commission’s recommendations for the December 2006 Draft Westend Subarea Plan and associated plan maps, the minutes of the Planning Commission meetings (February 6, 2007), the Planning Commission’s motions to accept the draft, a copy of the draft plan and maps, and copies of the written comments submitted to the Planning Commission; and,

 

WHEREAS, on February 27, 2007, after reviewing the Planning Commission’s recommendation, reviewing the designations in Section 20, Township 2 North, Range 5 East, WM, and discussing and analyzing the information, the Board of County Commissioners determined that the West End Community Comprehensive Subarea Plan and Maps, as initiated on December 27, 2006, protects the general health, safety and welfare of the public and should be approved; and,

 

WHEREAS, RCW 36.70.440 allows the Board of County Commissioners to approve by motion and certify the Comprehensive Plan, after receipt of the report and recommendation of the planning agency without further reference to the planning commission, provided that the plan conforms either to the proposal as initiated by the county commissioners or the recommendation thereon by the planning commission.  No further pubic hearings are required since the planning agency issued its report within 90 days of the Board of County Commissioners Initiating the draft text and maps; and,

 

NOW THEREFORE, BE IT RESOLVED, that the Skamania County Board of Commissioners adopts and endorses the Final West End Community Comprehensive Subarea Plan and Associated Plan Maps which amend the 1977 Comprehensive Plan “A”, which is the December 27, 2006 BCC Initiated Westend Subarea Plan; and,

 

BE IT FURTHER RESOLVED, that the Final West End Community Comprehensive Subarea Plan and Associated Plan Maps shall serve as a guideline to be used in the creation of zoning text and maps for the West End Community.
