NOTICE OF PUBLIC HEARING
PURPOSE: Skamania County Board of Commissioners hereby gives notice that a public hearing will be held to consider public comment regarding the adoption of Ordinance 2007-13 repealing the moratorium on the acceptance and processing of building, mechanical and/or plumbing permits on any parcel of land 20 acres or larger that was created by deed since February 16, 2006, the acceptance and processing of land divisions (subdivisions and short subdivisions) creating lots of less than 10 acres, on the construction/placement of more than one single-family dwelling per legal lot of record, and the acceptance and processing of State Environmental Policy Act (SEPA) checklists related to forest practice conversions for any parcel located within Township 6 North, Range 5 East; Township 7 North, Range 5 East; Township 6 North, Range 6 East; and Township 7 North, Range 6 East, Willamette Meridian.
Written testimony/comments to be considered at the public hearing by the Board of Commissioners must be received by the Clerk of the Board by noon on the Thursday preceding the date of the public hearing. Anyone interested may appear and be heard.

(AN ORDINANCE TO REPEAL ORDINANCE 2006-02, ORDINANCE 2006-10, ORDINANCE 2007-01 AND ORDINANCE 2007-09 - A MORATORIUM ON THE ACCEPTANCE AND PROCESSING OF ANY BUILDING, MECHANICAL, AND/OR PLUMBING PERMITS ON ANY PARCEL OF LAND THAT IS 20 ACRES OR LARGER THAT WAS CREATED BY DEED SINCE FEBRUARY 16, 2006, THE ACCEPTANCE AND PROCESSING OF LAND DIVISIONS (SUBDIVISION AND SHORT SUBDIVISION) CREATING LOTS OF LESS THAN 10 ACRES, ON THE CONSTRUCTION/PLACEMENT OF MORE THAN ONE SINGLE FAMILY DWELLING PER LEGAL LOT OF RECORD, THE ACCEPTANCE AND PROCESSING OF STATE ENVIRONMENTAL POLICY ACT (SEPA) CHECKLISTS RELATED TO FOREST PRACTICES CONVERSIONS FOR PARCELS LOCATED WITHIN TOWNSHIP 6 NORTH, RANGE 5 EAST; TOWNSHIP 7 NORTH, RANGE 5 EAST; TOWNSHIP 6 NORTH, RANGE 6 EAST; AND TOWNSHIP 7 NORTH, RANGE 6 EAST, WILLAMETTE MERIDIAN. ALL THE AFOREMENTIONED AREA IS GENERALLY KNOWN AS THE SWIFT SUBAREA OF SKAMANIA COUNTY.)
WHEREAS, The Board of County Commissioners on July 3, 2007, modified and extended the moratorium on the acceptance and processing of any building, mechanical, and/or plumbing permits on any parcel of land that is 20 acres or larger that was created by deed since February 16, 2006, the acceptance and processing of land divisions (subdivisions and short subdivisions) creating lots of less than 10 acres, on the construction/placement of more than one single-family dwelling per legal lot of record, and the acceptance and processing of State Environmental Policy Act (SEPA) checklists related to forest practice conversions for any parcel located within Township 6 North, Range 5 East; Township 7 North, Range 5 East; Township 6 North, Range 6 East; and Township 7 North, Range 6 East, Willamette Meridian. All the aforementioned area is generally known as the Swift Subarea of Skamania County.
WHEREAS, the Board of County Commissioners finds that the adoption of the 2007 Comprehensive Plan with Critical Area Guidance, the Swift Subarea Plan and the Interim Swift Zoning is sufficient to protect the Swift Subarea from incompatible uses and unplanned/uncontrolled residential growth; and,
WHEREAS, there is a work plan in place for the legislative process to adopt final Swift Zoning; and,
WHEREAS, the Board of County Commissioners, having provided proper notice in the official newspaper of general circulation and with a quorum present, conducted a public hearing to consider repealing the Swift Subarea Moratorium on October 16, 2007 in the Board of County Commissioner’s Meeting Room at 5:30 pm; and,
WHEREAS, after all those attending the hearing were given the opportunity to speak, the public hearing was closed to further public testimony; and,
NOW, THEREFORE BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS: the Board of County Commissioners hereby repeals Ordinance 2006-02, Ordinance 2006-10, Ordinance 2007-01 and Ordinance 2007-09 that established and extended the moratorium on the acceptance and processing of building, mechanical and/or plumbing permits on any parcel of land 20 acres or larger that was created by deed since February 16, 2006, the acceptance and processing of land divisions (subdivisions and short subdivisions) creating lots of less than 10 acres, on the construction/placement of more than one single-family dwelling per legal lot of record, and the acceptance and processing of State Environmental Policy Act (SEPA) checklists related to forest practice conversions for any parcel located within Township 6 North, Range 5 East; Township 7 North, Range 5 East; Township 6 North, Range 6 East; and Township 7 North, Range 6 East, Willamette Meridian, until the Comprehensive Plan Amendment for the proposed Swift Subarea Plan and the Critical Areas Update Process are complete. (All the aforementioned area is generally known as the Swift Subarea of Skamania County).
BE IT FURTHER ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS that the ordinance and its recitals, shall constitute the Board of County Commissioner’s findings of facts.
