ORDINANCE 2005-11

(TITLE 22 MAP AMENDMENT (KANTJAS) AMEND THE DESIGNATION OF PARCEL NUMBER 03-09-32-3-0-0200-00 FROM SMA OPEN SPACE TO SMA FOREST)

 

WHEREAS, Skamania County Code Title 22 and the associated maps were adopted by the Skamania County Board of Commissioners effective December 21, 1993; and

 

WHEREAS, Section 22.02.010, Substantive Authority, states the policies, standards and regulations set forth in Title 22 are adopted pursuant to the authority given to the County under the Columbia River Gorge National Scenic Area Act and Chapter 43.97 RCW; the comprehensive management plan adopted by the Columbia River Gorge Commission on October 15, 1991, as it may be amended from time to time; and the Washington State Growth Management Act (Chapter 36.70A); and

 

Whereas, on April, 27, 2004 the Columbia River Gorge Commission and the USDA Forest Service, National Scenic Area adopted Revisions to the Management Plan, including the associated maps, for the Columbia River Gorge National Scenic Area amending the comprehensive management plan originally adopted by the Columbia River Gorge Commission on October 15, 1991; and

 

WHEREAS, on October 25, 2004, the Board of County Commissioners authorized the Planning Department to initiate the public process for the local adoption of the revised management plan; and

 

Whereas, a Determination of Non-Significance (DNS) was issued on June 29, 2005 after environmental review of the draft text was completed and listing the map amendments.  No appeals were filed so the decision is final; and

 

Whereas, the Planning Commission held workshop on June 21, 2005 to discuss the proposed replacement text and maps for Title 22; and

 

Whereas, notice of the public hearing was provided in the official newspaper of general circulation at least 10 days prior to the public hearing, meeting the notification requirements; and

 

Whereas, the Planning Commission held a legislative public hearing on July 19, 2005 where public comments were taken and then the public hearing was closed to further testimony; and

 

Whereas, on July 19, 2005, the Planning Commission voted to recommend approval of the map amendment from SMA Open Space to SMA Forest; and

 

Whereas, on October 18, 2005, the Board of County Commissioners held a workshop during a public meeting on Ordinance 2005-11; and

 

Whereas, official notice of the public hearing was provided in the official newspaper of general circulation at least 10 days prior to the public hearing, meeting the notification requirements; and,

 

Whereas, on November 7, 2005, at 1:30 pm the Board of County Commissioners held a legislative public hearing on Ordinance 2005-11;

 

NOW THEREFORE the Board of County Commissioners hereby adopts, by reference the Staff Report dated October 5, 2005, and concurs with the Planning Commission’s recommendation to approve the map amendment for parcel number 03-09-32-3-0-0200-00 from SMA Open Space to SMA Forest.

 

BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS:  that Skamania County Parcel Number 03-09-32-3-0-0200-00 be rezoned from SMA Open Space to SMA Forest.

 

BE IT FURTHER ORDAINED that this ordinance shall become effective upon adoption by the Board of County Commissioners, approved consistency review by the Columbia River Gorge Commission, and concurrency by the United States Secretary of Agriculture.

 

ACKNOWLEDGED ON CONSENT AGENDA IN REGULAR SESSION this 24th day of October 2005 and set for public hearing on the 7th day of November 2005 at 1:30 o’clock p.m.
