ORDINANCE NO. 2005-05

 

(AN ORDINANCE AFFECTING SKAMANIA COUNTY CODE TITLE 9 BY AMENDING SECTION 9.12.010 PUBLIC CARD ROOMS)

 

 

WHEREAS, the 1973 Washington State Gambling Act, RCW 9.46, and the regulations of the Washington State Gambling Commission, WAC 230, permit certain card games constituting gambling, when licensed by the Commission, which are sponsored either by a bona fide charitable or nonprofit organization for its members and their guests only (“social card room”) or by a for profit organization as a commercial retail business stimulant (“public card room”); and

 

WHEREAS, RCW 9.46.295 authorizes counties and cities to prohibit any of the gambling activities otherwise permitted to be licensed by the State Gambling Commission; and

 

Whereas, Chapter 9.12 of Skamania County Code Title 9 was adopted by the Board of County Commissioners in April 1985, as authorized by RCW 9.46.295, to prohibit certain gambling activities otherwise permitted to be licensed by the State Gambling Commission; and,

 

Whereas, the Board of County Commissioners has determined that an exception should be allowed to permit “public card rooms” within establishments in the unincorporated areas of Skamania County who are authorized by the Washington State Gambling Commission to sell pull tabs.

 

NOW, THEREFORE, BE IT ORDAINED BY THE SKAMANIA COUNTY BOARD OF COMMISSIONERS THAT Skamania County Code Title 9, Chapter 9.12 Public Card Rooms be amended as follows:

 

CHAPTER 9.12        PUBLIC CARD ROOMS

 

Section:

9.12.10                             Prohibited.

 

The Board of County Commissioners deems it to be in the public’s interest and necessary for the public’s health, safety and welfare to prohibit “public card rooms” as defined by WAC 230-02-410, within the unincorporated areas of Skamania County, except within establishments authorized by the Washington State Gambling Commission to sell pull tabs.

 

BE IT FINALLY ORDAINED that this ordinance shall become effective upon adoption by the Board of Commissioners of Skamania County.
