ORDINANCE 2004-03

 

(AN ORDINANCE PROVIDING FOR THE ADOPTION OF THE SOLID WASTE HANDLING STANDARDS, CHAPTER 173-350 WAC AS THE SAME MAY NOW EXIST OR HEREAFTER BE AMENDED AND PROVIDING FOR VIOLATION THEREOF)

 

 

WHEREAS, the Skamania County Health Department is responsible for ensuring that the disposal of solid waste does not adversely affect the public health of the citizens of Skamania County; and

 

WHEREAS, Chapter 173-350 WAC sets forth standards for the handling of solid waste and a penalty for failure to comply with the standards of which Skamania County was previously a participant; and

 

WHEREAS, a similar Solid Waste Enforcement ordinance, adopted by Southwest Washington Health District, was in effect when Skamania Country was a party to that now-disbanded district; and

 

WHEREAS, the Skamania County Board of Commissioners has determined that the public health, safety and welfare of the people of Skamania County would best be served by the adoption of standards and provision for violation thereof to help ensure the adequate and safe disposal of solid waste throughout Skamania County,

 

NOW, THEREFORE, BE IT ORDAINED BY THE SKAMANIA COUNTY BOARD OF COMMISSIONERS THAT:

 

1.                  The Solid Waste Handling Standards – Chapter 173-350 WAC, effective February 10, 2003, are hereby adopted by reference as the solid waste handling code of Skamania County as the same may now exist or hereafter be amended.  Any subsequent amendment to Chapter 173-350 WAC shall be considered to have been incorporated into this chapter without the need for further amendment.

 

2.                  Violation Penalty – Any person, firm or corporation violating or failing to comply with the provisions of this chapter shall be deemed guilty of an infraction and upon conviction, shall be subject to a fine of up to $100.  Each day a violation of this chapter continues shall be considered a separate offense.

 

3.                  Severability Clause – If any provision of this regulation or its application to any person or circumstance is declared unconstitutional or invalid for any reason, such declaration shall not affect the validity of the remainder of the regulation or its application.
