ORDINANCE 2003-10

 

 

(AN ORDINANCE CONTAINING MAP AMENDMENTS FOR CERTAIN PARCELS FROM SPECIAL MANANGEMENT, ZONING DESIGNATIONS

TO GENERAL MANANGEMENT, ZONING DESIGNATIONS)

 

 

WHEREAS, listed parcels (see below) in the Columbia River Gorge National Scenic Area were offered for sale to the United States Department of Agriculture (Forest Service) through the Section 8(o) process. The Forest Service has designated General Management Area zoning for these parcels, therefore requesting that said parcels be changed to the designated General Management area zoning, if not purchased by the Forest Service within the allotted 3 year period.

 

WHEREAS, on June 11, 2003, the Planning Department issued a Determination of Non-Significance (DNS) in order to fulfill the State Environmental Policy Act (SEPA) required review, which determined that the proposed rezones would not adversely affect the environment, and

 

WHEREAS, on July 1, 2003, the Skamania County Planning Commission, after providing proper notice and with a quorum present, conducted a public hearing with regard to the above stated request.  After the hearing was closed to public testimony, the members of the Planning Commission present, constituting a majority of total seated members, voted to recommend to the Board of County Commissioners (Board) that the rezone map amendment be approved, and

 

WHEREAS, the Board acknowledged receipt of the record, gave proper notice and reviewed the Planning Commission’s recommendation at a public meeting, and

 

WHEREAS, the Board, after review of the Planning Commission’s recommendation, set this matter on for a hearing so as to be adopted as an Ordinance as required by RCW 36.70.570;

 

NOW, THEREFORE the Board of County Commissioners hereby adopts, by reference the Staff Report dated June 23, 2003, and concurs with the Planning Commission’s recommendation to rezone the  parcels (see attached Exhibits) from SMA to GMA, if not purchased by the Forest Service within the allotted 3 year period, and if this 3 year deadline is not otherwise extended by the property owner as provided in 16 USC 544f(o).

 

BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS:  that the stated parcels listed below in Skamania County are rezoned from SMA to the below stated GMA designation.

 

BE IT FURTHER ORDAINED that this ordinance, unless the 3-year deadline is extended by the landowner, the landowner rejects the offer, the landowner sells the property to a third party prior to expiration, the Forest Service finding that the offer was non-bona fide offer or other actions that result in parcel remaining the current designation, shall become effective at midnight on the expiration date listed for each parcel listed below provided that the Forest Service does not purchase said parcels, in which case the zoning shall not change.
