ORDINANCE NO. 2002 – 20

 

(AN ORDINANCE REVISING SKAMANIA COUNTY CODE TITLE 21 SECTIONS 21.28.020, 21.28.030, 21.32.031, 21.36.031, 21.40.030, 21.44.030, 21.48.021, 21.48.031, 21.50.020, 21.50.030, 21.87.090, 21.87.100, 21.87.110, 21.87.120, and 21.87.140, allowing Mobile Home and Recreational Vehicle Parks as Conditional Uses in SELECTED zone designations)

 

WHEREAS, the Skamania County Planning Department held eight public meetings with a committee made up of landowners and representatives of various county and state agencies to discuss ways to create small-scale recreational vehicle parks within Skamania County; and

 

WHEREAS, the Skamania County Planning Commission held two workshops in fall of 2001 to review the draft small-scale recreational vehicle park ordinance; and

 

WHEREAS, the Skamania County Planning Commission held two public workshops in July 2002 on the draft ordinance to replace Title 18 – Mobile Home and Recreational Vehicle Park Ordinance; and

 

WHEREAS, the environmental determination was made and the Determination of Non-Significance issued September 18, 2002; and

 

WHEREAS, these meetings and workshops all discussed the various zone classifications where these parks could be allowed as conditional uses; now therefore

 

BE IT HEREBY ORDAINED AND ESTABLISHED that the following is the final draft of the ordinance revising Skamania County Code Title 21 Sections 21.28.020, 21.28.030, 21.32.031, 21.36.031, 21.40.030, 21.44.030, 21.48.021, 21.48.031, 21.50.020, 21.50.030, 21.87.090, 21.87.100, 21.87.110, 21.87.120, and 21.87.140, allowing mobile home and recreational vehicle parks as conditional uses in selected zone classifications:

 

CHAPTER 21.28 - RESIDENTIAL 1 ZONE CLASSIFICATION (R-1)

 

21.28.020            PERMITTED USES

 

               A.      Single‑family dwellings

               B.      Duplexes

               C.      Triplexes

               D.      Four-plexes

               E.      Professional services

               F.       Public facilities and utilities

               G.      Cottage occupation

               H.      Light home industry

               I.       Domestic agriculture

               J.       Residential care facilities (In accordance with Chapter 21.85)

               K.      Child care facilities (In accordance with Chapter 21.86)

CHAPTER 21.48 - COMMUNITY COMMERCIAL ZONE CLASSIFICATION (CC)

 

21.48.021            PERMITTED USES

 

               P.      Lodging Places

                        1.       Hotels and motels

 

21.48.031            CONDITIONAL USES

 

               A.      Small-Scale and Large-Scale Recreational Vehicle Parks.

               B.      All commercial uses and/or other uses other than those commercial uses listed in Section 21.48.021 shall be considered conditional uses.

              

CHAPTER 21.50 - COMMERCIAL RECREATION ZONE CLASSIFICATION  (CR)

 

21.50.020            PERMITTED USES

 

               A.      Overnight lodging facilities.

               B.      Food and drink service facilities.

               C.      Recreational service facilities and related equipment sales and rentals.

               D.      Outdoor recreational facilities such as piers and docks, boat launches, tennis courts, swimming pools, fee fishing ponds, and golf courses.

               E.      Planned unit developments when approved in accordance with county standards promulgated for same.

               F.       Forestry

               G.      One single-family residential dwelling when used by the caretaker or the owner of the permitted commercial recreation development.

               H.      One single-family residential dwelling may be permitted on lots created prior to the date of adoption of this ordinance.

 

21.50.030  CONDITIONAL USES

 

               A.      Convenience store

               B.      Automobile service station

               C.      Buildings and uses of a public works, public service or public utility nature.

               D.      Other uses determined by the Board of Adjustment to be in keeping with the intent of this zone classification and any associated special purpose district overlay zone.

               E.      Small-Scale and Large-Scale Recreational Vehicle Parks

 

 

Carson Area Zone Classifications:         

21.87.090      HIGH DENSITY RESIDENTIAL ZONE CLASSIFICATION (HDR).

 

B.      REVIEW USES.

 

         1.   Multi‑family housing units.

         2.   Light home industry.

         3.   Cottage occupations.

         4.   Residential care facilities, consistent with Chapter 21.85 of this title.

         5.   Child care facilities, consistent with chapter 21.85 of this title.

         6.   Safe homes.

         7.   Cluster Developments.

 

C.      CONDITIONAL USES.

 

         1.   Professional services.

         2.   Commercial agriculture.

         3.   Mobile Home Parks

 

21.87.100 RURAL RESIDENTIAL ZONE CLASSIFICATION (RR).

 

C.      CONDITIONAL USES.

 

         1.   Multi‑family housing units.

         2.   Mobile home parks.

         3.   Professional services.

         4.   Commercial agriculture.

 

E.      PROHIBITED USES. 

 

         Any uses not listed above are prohibited, including but not limited to:

 

               1.   Small-Scale and Large-Scale Recreational Vehicle Parks.

               2.   Commercial uses.

               3.   Industrial uses.

               4.   Billboards.

               5.   Above ground utility lines, unless no practical alternative exists.

               6.   Unconcealed, outdoor storage of non‑functioning vehicles and parts thereof, appliances, construction materials, debris and household garbage.

 

21.87.110  RURAL ESTATE ZONE CLASSIFICATION (RE).

 

C.      CONDITIONAL USES.

 

         1.   Multi‑family housing units.

         2.   Small-Scale and Large-Scale Recreational Vehicle Parks.

         3.   Commercial agriculture.

 

E.      PROHIBITED USES. 

 

         Any uses not listed above are prohibited, including, but not limited to:

 

               1.   Commercial uses.

               2.   Industrial uses.

               3.   Professional services.

               4.   Billboards.

               5.   Mobile home parks

               6.   Above ground utility lines, unless no practical alternative exists.

               7.   Unconcealed, outdoor storage of non‑functioning vehicles and parts thereof, appliances, construction materials, debris and household garbage.

 

21.87.120  COMMERCIAL (C).

 

C.      CONDITIONAL USES.

 

         1.   Residential use above/over a commercial use: street level floor must be commercial/professional use only.

         2.   Owner/caretaker residence in conjunction with commercial use.

         3.   Small-Scale and Large-Scale Recreational Vehicle Parks

 

E.      PROHIBITED USES. 

 

         Any uses not listed above are prohibited, including but not limited to:

        

         1.   Residential uses.

         2.   Mobile Home parks

         3.   Billboards.

         4.   Above ground utility lines, unless no practical alternative exists.

         5.   Unconcealed, outdoor storage of non‑functioning vehicles and parts thereof, appliances, construction materials, debris and household garbage.

 

21.87.140  DESTINATION RESORT (DR).

 

A.     ALLOWED USES.

 

         1.   Residential Development in conjunction with destination resort facilities.

         2.   Overnight lodging and convention facilities.

         3.   Food and drink service facilities.

         4.   Recreational service facilities and related equipment sales and rentals.

         5.   Outdoor recreational facilities.

         6.   Advertising signs; on‑premises advertising only.

 

B.      REVIEW USE.  

 

         1.   None

                          

C.      CONDITIONAL USES.

 

         1.   Owner/caretaker residence in conjunction with a destination resort.

         2.   Small-Scale and Large-Scale Recreational Vehicle Parks

 

E.      PROHIBITED USES. 

 

         Any uses not listed above are prohibited, including but not limited to:

 

   1.   Residential uses.

   2.   Mobile Home Parks.

   3.   Billboards.

   4.   Above ground utility lines, unless no practical alternative exists.

         5.   Unconcealed, outdoor storage of non‑functioning vehicles and parts thereof, appliances, construction materials, debris and household garbage.

 

 

BE IT FINALLY ORDAINED that this ordinance shall become effective upon adoption by the County Commissioners of Skamania County.
