ORDINANCE 2002-11

(AN ORDINANCE REZONING CERTAIN PROPERTY FROM

RESIDENTIAL 10 TO RESIDENTIAL 5)

 

WHEREAS, On July 24, 2001, Rudie Klopman, Edmund and Patricia Spencer, and Sandra Matney submitted to the Skamania County Department of Planning and Community Development (Planning Department) an application to rezone approximately 17.5 acres from Residential 10 (R-10) to Residential 5 (R-5). The properties are located at the east end of Harder Road, in Washougal, Section 19, T2N R5E W.M., Skamania County Tax Lot No. 02-05-19-0-0-1300 (10.0 acres), 02-05-19-0-0-1307 (2.5 acres), and 02-05-19-0-0-1313 (5.0 acres).

 

WHEREAS, on October 17, 2001, the Planning Department issued a “Mitigated” Determination of Non-Significance (MDNS) in order to fulfill the State Environmental Policy Act (SEPA) required review, which determined that the proposed rezone would not adversely affect the environment, and

 

WHEREAS, The Skamania County Planning Commission, after providing proper notice and with a quorum present, conducted public hearings on the above stated request. At the November 6, 2001, hearing the Planning Commission deemed the application incomplete. The public hearing was continued to February 5, 2002. After the hearing was closed to public testimony, the members of the Planning Commission present, constituting a majority of the total members, voted unanimously to forward the rezone request application to the Board of County Commissioners (Board) without a recommendation, and

 

WHEREAS, the Board acknowledged receipt of the record, gave proper notice and scheduled a new public hearing to make a final decision, and

 

WHEREAS, the Board conducted a new public hearing on April 9, 2002, received new testimony, reviewed the Planning Commission’s record, approved the rezone request and authorized an ordinance hearing to change the official zoning maps be set as required by RCW 36.70.570;


NOW, THEREFORE the Board of County Commissioners hereby adopts by reference the Findings of Fact and Conclusions listed in the Planning Department’s statement dated March 8, 2002, and approves the rezone request of the above stated property from Residential 10 to Residential 5.

 

BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS: that Skamania County Tax Lot Nos. 02-05-19-0-0-1300, 02-05-19-0-0-1307, and 02-05-19-0-0-1313 be zoned Residential 5.

 

BE IT FURTHER ORDAINED that this ordinance shall become effective upon adoption.
