ORDINANCE 2002-04

 

 

AN ORDINANCE REZONING CERTAIN PROPERTY FROM RESOURCE PRODUCTION ZONE (FORAG 20) TO RESIDENTIAL-5 (R-5)

 

 

WHEREAS, on November 27, 2001, Robert Brown submitted to the Skamania County Department of Planning and Community Development an application to rezone two parcels totaling approximately 72.21 acres in size from Resource Production (FORAG 20) to Residential 5 (R-5).  The two parcels are located approximately 325 feet south of the intersection of Salmon Falls Road and Silver Star Lane (private), and lying west of Salmon Falls Road, in Washougal, Section 33 of T2N, R5E W.M. identified as tax lot number 02-05-33-0-0-2900-00 (55.29 acres) and also in Section 4 of T1N, R5E W.M. identified as tax lot number 01-05-04-0-0-0200-00 (16.92 acres); and,

 

WHEREAS, the subject rezone was reviewed under the State Environmental Policy Act (SEPA).  A Mitigated Determination of Non-Significance (MDNS) was issued and published on January 16, 2002. The mitigation measure requires all future development to complete a stormwater runoff plan to ensure the protection of the natural drainage areas; and,

 

WHEREAS, on February 5, 2002, the Skamania County Planning Commission, after providing proper notice and with a quorum present, reviewed the evidence presented in the staff report, and conducted a public hearing to consider the proposed rezone.  The members of the Planning Commission present, constituting a majority of total seated members, voted unanimously to recommend to the Board of County Commissioners (Board) that the rezone be approved, and,

 

WHEREAS, the Board acknowledged receipt of the record, gave proper notice, reviewed the Planning Commission’s recommendation at a public meeting, and set this matter on for a hearing so as to be adopted as an Ordinance as required by RCW 36.70.570; and,

 

NOW, THEREFORE the Board of County Commissioners hereby adopts by reference the Planning Department’s staff report and the Planning Commission’s Findings of Fact and Conclusions for this application dated November 27, 2001, and concurs with its recommendation to rezone the above stated property from Resource Production (FORAG 20) to Residential 5 acre (R-5).

 

BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS:  that Skamania County Assessor’s Tax Lot Nos. 02-05-33-0-0-2900-00 and 01-05-04-0-0-0200-00 be zoned Residential 5.
