ORDINANCE 2002-01

(AN ORDINANCE REZONING CERTAIN SPECIAL MGMT., ZONING

TO A GENERAL MGMT., ZONING)

WHEREAS, 2 parcels (see Exhibit “1” attached) in the Columbia River Gorge National Scenic Area were offered for sale to the United States Department of Agriculture (Forest Service) through the Section 8(o) process. The Forest Service has designated General Management Area zoning for the 2 parcels, therefore requesting that those said parcels (see Exhibit “1” attached) be changed to the designated General Management area zoning, if not purchased buy the Forest Service within the allotted 3 year period.

WHEREAS, on December 12, 2001, the Planning Department issued a Determination of Non-Significance (DNS) in order to fulfill the State Environmental Policy Act (SEPA) required review, which determined that the proposed rezone would not adversely affect the environment, and

WHEREAS, on December 18, 2001, the Skamania County Planning Commission, after providing proper notice and with a quorum present, conducted a public hearings with regard to the above stated request. After the hearing was closed to public testimony, the members of the Planning Commission present, constituting a majority of total seated members, voted to recommend to the Board of County Commissioners (Board) that the rezone be approved, and

WHEREAS, the Board acknowledged receipt of the record, gave proper notice and reviewed the Planning Commission’s recommendation at a public meeting, and

WHEREAS, the Board, after review of the Planning Commission’s recommendation, set this matter on for a hearing so as to be adopted as an Ordinance as required by RCW 36.70.570;

NOW, THEREFORE the Board of County Commissioners hereby adopts, by reference the Staff Report dated December 18, 2001, and concurs with the Planning Commission’s recommendation to rezone the 2 parcels (see Exhibit “1” attached) from SMA to GMA, if not purchased by the Forest Service within the allotted 3 year period, and if this 3 year deadline is not otherwise extended by the property owner as provided in 16 USC 544f(o).

BE IT HEREBY ORDAINED AND ESTABLISHED BY THIS BOARD OF COUNTY COMMISSIONERS AS FOLLOWS: that Skamania County Assessor’s Tax Lot Numbers 03-08-36-00-0600 & 03-09-31-00-0301 be rezoned from SMA/Forest to GMA/Small Woodland (F3).

BE IT FURTHER ORDAINED that this ordinance, unless the 3 year deadline is extended by the landowner, shall become effective at midnight on April 12, 2002 provided that the Forest Service does not purchase said parcels in which case the zoning shall not shall not change.
